1. Overview
This Privacy Policy explains how Prostack Media ("Prostack Media," "we," "us," or "our"), a digital marketing agency located in New Hyde Park, New York, collects, uses, shares, and protects personal information. It applies to our website at https://prostackmedia.com (the "Site"), to messages you send us by form, email, phone, or text, and to our text messaging program.
We wrote this policy to be read, not skimmed past. If something is unclear, contact us using the details in the Contact us section and we will explain it.
When we provide marketing services to a client, we may handle information about that client's own customers on the client's behalf and under the client's instructions. In that case the client's privacy policy governs that information, and questions about it should go to the client first.
2. Information we collect
Information you give us
The Site does not have user accounts and does not take payments. The main way we collect information is our contact form, which asks for:
- Your name
- Your email address
- Your phone number
- Your company name
- The service you are interested in
- Your message to us
- Your choices on the optional text messaging checkboxes, along with a record of when and how you gave consent (for example, the date, time, page, and the consent wording you agreed to)
We also collect whatever you choose to share when you email us, call us, text us, or meet with us, such as details about your business and marketing goals.
Information collected automatically
Like most websites, the Site and the services that host it may automatically receive standard technical information when you visit, such as your IP address, browser type, device type, operating system, the pages you view, the page that referred you, and the date and time of your visit. This information typically comes from server logs and from Google Analytics, which uses cookies (see Cookies and analytics).
Information from third-party features
Our contact page includes an embedded Google Map. When your browser loads the map, it connects directly to Google's servers, and Google may receive your IP address and basic browser information. Google's handling of that information is described in the Google Privacy Policy.
To protect our contact form from spam, it may use Google reCAPTCHA, which collects hardware and software information, such as device and application data, and sends it to Google for analysis. Your use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service. Contact form submissions are received and stored by our website hosting provider on our behalf so that we can respond to you.
Sensitive information
We do not ask for sensitive personal information such as Social Security numbers, financial account numbers, health information, or precise geolocation through the Site. Please do not send that kind of information through our contact form or by text message.
3. How we use your information
We use personal information to:
- Respond to your inquiry and talk with you about our services
- Schedule and remind you about consultations and appointments
- Provide, manage, and report on services you engage us for, including project updates
- Send text messages you have agreed to receive, as described in the Text messaging section
- Send marketing emails or texts, but only where you have agreed or where the law otherwise allows it, and always with a way to opt out
- Keep the Site working, secure, and free of spam and abuse
- Understand how visitors use the Site so we can improve it
- Keep records of consent and opt out requests
- Comply with the law, enforce our Terms of Service, and protect our rights and the rights of others
We do not use your information to make decisions about you based solely on automated processing that would have legal or similarly significant effects.
4. Legal bases for processing
Our business is based in the United States and serves U.S. clients. If you are in a place that requires a legal basis for processing personal information, such as the European Economic Area or the United Kingdom, we rely on:
- Consent, for example when you check a box to receive text messages. You can withdraw consent at any time.
- Steps before a contract and performance of a contract, when you ask about or engage our services.
- Legitimate interests, such as answering business inquiries, running and securing the Site, and improving our services, balanced against your rights.
- Legal obligations, such as keeping records the law requires.
5. Cookies and analytics
Cookies are small files a website stores in your browser. Similar technologies include pixels and local storage.
The Site is kept fairly lean. It relies on what is needed to load and display pages, Google Analytics, and the Google Maps feature described above, which may set or read its own cookies or collect technical data when it loads.
We use Google Analytics, a web analytics service provided by Google LLC, to understand which pages are visited, how people find the Site, and how well it works. Google Analytics sets cookies (such as _ga) and collects information such as the pages you view, how long you stay, the site that referred you, your device and browser type, and your approximate location based on your IP address. We look at this information in aggregate to improve the Site. Google's use of this information is described in How Google uses information from sites that use its services. You can opt out with the Google Analytics Opt-out Browser Add-on.
We do not use cookies or other tools on the Site for cross-context behavioral advertising.
You can block or delete cookies through your browser settings. The Site will still work if you do, although an embedded map may not load.
6. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising (also called targeted advertising). We have not done so in the past 12 months.
We share personal information only in these limited situations:
- Service providers. Companies that help us run our business and act on our behalf, such as website hosting, form handling, email, scheduling, analytics (Google Analytics), and text message delivery providers such as Twilio or Telnyx. They may use the information only to provide services to us and must protect it.
- Professional advisers. Lawyers, accountants, and similar advisers who are bound by confidentiality.
- Legal reasons. When we believe in good faith that disclosure is required by law, subpoena, or court order, or is needed to protect the safety, rights, or property of you, us, or others.
- Business changes. If Prostack Media is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that deal, subject to this policy. This does not apply to text messaging opt-in data and consent, which are never transferred to a third party, as explained in the Text messaging section.
- With your direction. When you ask us to share something, for example by introducing you to a partner.
We do not share personal information with affiliates or other third parties for their own marketing purposes.
7. Text messaging (SMS) and mobile information
If you give us your mobile number and check one or both of the optional boxes on our contact form, or ask us verbally or in writing to text you, we may send you text messages. There are two separate types, and you choose each one separately:
- Customer care messages, such as replies to your inquiry, appointment and consultation reminders, and project and account updates.
- Marketing messages, such as offers, marketing tips, and company news. We send these only if you specifically opt in to them.
The checkboxes are never checked in advance, and you can submit our contact form without checking either one. Consent to receive text messages is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Full program details are in our text message terms.
We use your mobile number and consent only to send the messages you asked for, to keep a record of your consent and any opt out, and to respond to you.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
The only exception is sharing with subcontractors that support our services, such as the text message delivery providers (for example Twilio or Telnyx) and wireless carriers that transmit our messages, and providers that help us with customer service. These subcontractors may use your information only to deliver our messages and support our service, and may not use it for their own marketing. All other categories of sharing described in this policy exclude text messaging originator opt-in data and consent, and that information will not be sold, rented, or shared with any third parties.
Text messaging is available only to people who are 18 or older, or the age of majority where they live.
8. How long we keep information
We keep personal information only as long as we need it for the purposes described in this policy. In general:
- Inquiries that do not become client relationships are kept for as long as reasonably needed to follow up and handle related questions, and then deleted or anonymized.
- Client information is kept for the length of the engagement and afterward as needed for records, taxes, and legal obligations.
- Records of text messaging consent and opt out requests are kept for as long as needed to prove consent and honor opt outs, which may be several years after your last message because of legal limitation periods.
- Technical logs are kept for a limited period for security and troubleshooting.
When information is no longer needed, we delete it or make it so it can no longer identify you.
9. How we protect information
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, consistent with the New York SHIELD Act and other applicable laws. These include limiting access to people who need it, using reputable service providers, encrypting data in transit to and from the Site, and reviewing our practices over time.
No method of storing or sending information is completely secure, so we cannot guarantee absolute security. If a security breach affects your personal information, we will notify you and the appropriate authorities as required by law.
10. Your privacy rights
Some state laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act, give residents specific rights over their personal information. We offer the following rights to everyone, wherever you live, subject to the limits and exceptions the law allows:
- Right to know and access. Ask what personal information we have about you, where it came from, why we use it, and who we share it with, and get a copy.
- Right to correct. Ask us to fix information that is inaccurate.
- Right to delete. Ask us to delete personal information we collected from you.
- Right to portability. Ask for a copy of your information in a commonly used format.
- Right to opt out of sale, sharing, and targeted advertising. We do not sell or share personal information or use it for targeted advertising, but you may still submit a request and we will record your preference.
- Right to limit use of sensitive information. We do not use sensitive personal information to infer characteristics about you.
- Right to withdraw consent. You can withdraw consent, such as consent to receive text messages or marketing emails, at any time.
- Right to appeal. If we decline your request, you can ask us to reconsider by replying to our decision.
How to make a request
Email info@prostackmedia.com or call us toll free at (844) 979-8787. Please tell us what you are asking for and how to reach you. To protect you, we will verify your identity before acting, usually by matching information you give us with what we already have. We will not ask for more information than we need.
You may use an authorized agent to make a request for you. We may ask the agent for proof of your written permission and may ask you to confirm your identity directly.
We will confirm receipt of your request and respond within 45 days. If we need more time, up to another 45 days, we will tell you why.
No discrimination
We will not deny you services, charge you a different price, or treat you differently because you exercised a privacy right.
Opting out of messages
To stop text messages, reply STOP to any message. To stop marketing emails, use the unsubscribe link in the email or contact us. We may still send you messages that are needed to respond to you or to provide services you engaged us for.
11. Children's privacy
The Site and our services are meant for businesses and adults. They are not directed to children under 13, and we do not knowingly collect personal information from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA). If you believe a child has given us personal information, contact us and we will delete it.
Our text messaging program is only for people who are 18 or older, or the age of majority where they live.
12. Links to other websites
The Site may link to other websites and platforms, such as social media pages or Google Maps. We do not control those sites, and this policy does not cover them. Please read their privacy policies before sharing information with them.
13. Do Not Track and Global Privacy Control
Some browsers send a "Do Not Track" signal. There is no common standard for how websites should respond to it. We do not track visitors across other websites, so the Site works the same way whether or not the signal is on.
Global Privacy Control (GPC) is a browser setting that tells websites you want to opt out of the sale or sharing of your personal information. We do not sell or share personal information, but if your browser sends a GPC signal, we treat it as a valid opt out request for that browser and for any information we can link to you, without asking you to do anything else.
14. Visitors outside the United States
Prostack Media is based in the United States, and the Site is intended for visitors in the United States. If you visit from another country, your information will be processed and stored in the United States, where privacy laws may be different from those where you live.
15. Changes to this policy
We may update this policy from time to time. When we do, we will change the "Last updated" date at the top. If we make a significant change, we will take reasonable steps to let you know, such as a notice on the Site. We will not use personal information in a materially different way than described here without giving you notice and, where the law requires, getting your consent.
